separate areas and normally involve different authorities and specialised professionals.<\/li><li>Customs clearance <strong>always<\/strong> needs to be<strong> <em>revised by a professional<\/em><\/strong> and in some form will need to be covered.<\/li><li>A yacht being accepted into port does <strong>not by itself prove that its customs clearance status or Temporary Admission position has been properly established<\/strong>.<\/li><li>Temporary admission <strong>IS NOT AUTOMATIC<\/strong> just because the yacht is foreign owned.<\/li><li>Serious owners and captains should ask <strong>which customs procedure was used, who handled it and what documentation confirms it<\/strong>.<\/li><li>Customs representation is a regulated activity; in Spain, representatives <strong>must be qualified<\/strong>, meet the applicable requirements and be <strong>registered<\/strong> with the customs <strong>authorities<\/strong> to act<\/li><li>Temporary Admission is conditional and must be monitored through its authorised period and ultimately discharged.<\/li><li>For all yacht owners and captains, it is <strong>considered a must that customs Port formalities may be completed. The captain may provide documents to the local yacht agent. Immigration and crew requirements may be dealt with. The port authority may accept the vessel. Customs clearance always needs to be <em>revised by a professional<\/em> and in some form will need to be covered, depending on the yacht&#8217;s circumstances and the customs procedure that applies.<\/p><p dir=\"auto\" data-start=\"3208\" data-end=\"3317\">From the owner&#8217;s or captain&#8217;s perspective, it can therefore be very easy to hear a reassuring phrase such as:<\/p><blockquote><h4 dir=\"auto\" style=\"text-align: center;\" data-start=\"3319\" data-end=\"3352\"><strong data-start=\"3319\" data-end=\"3352\">\u201cThe yacht has been cleared or the yacht is cleared\u201d<\/strong><\/h4><\/blockquote><p dir=\"auto\" data-start=\"3354\" data-end=\"3387\">But what does that actually mean?<\/p><p dir=\"auto\" data-start=\"3389\" data-end=\"3489\">The word <strong data-start=\"3398\" data-end=\"3434\">\u201ccleared\u201d is not specific enough<\/strong> when the subject is a non-Union yacht entering the EU.<\/p><p dir=\"auto\" data-start=\"3491\" data-end=\"3758\">A yacht can have its port and operational arrival formalities dealt with correctly by any yacht agent while its customs position requires separate attention. Equally, a customs procedure has the chance of being\u00a0 properly handled\u00a0 by a customs clearance professional while other arrival requirements are being managed by a yacht agent. <em>This is the &#8220;seasoned&#8221; captains route.<\/em><\/p><p dir=\"auto\" data-start=\"3760\" data-end=\"3833\">The important question is not whether somebody says the yacht is cleared.<\/p><p dir=\"auto\" data-start=\"3835\" data-end=\"3861\">The important question is:<\/p><p dir=\"auto\" data-start=\"3863\" data-end=\"3947\"><strong data-start=\"3863\" data-end=\"3947\">What was cleared, under which procedure, by whom, and what evidence is offered that confirms it?<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-65a1887 elementor-widget elementor-widget-heading\" data-id=\"65a1887\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">The Word \u201cCLEARED\u201d Can Mean Very Different Things In Yacht Customs Clearance In The EU<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba06c27 elementor-widget elementor-widget-text-editor\" data-id=\"ba06c27\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"PDq2pG_selectionAnchorContainer\" dir=\"auto\" data-start=\"3999\" data-end=\"4184\">Yacht owners and captains often work with a yacht agent who coordinates a wide range of arrival requirements. That does NOT, by itself, tell the owner whether the yacht has been:<\/p><ul data-start=\"5129\" data-end=\"5306\"><li data-section-id=\"1uidlna\" data-start=\"5129\" data-end=\"5164\"><strong>placed under Temporary Admission;<\/strong><\/li><li data-section-id=\"1s2asdq\" data-start=\"5165\" data-end=\"5197\"><strong>released for free circulation;<\/strong><\/li><li data-section-id=\"mgvb6v\" data-start=\"5198\" data-end=\"5243\"><strong>dealt with under another customs procedure;<\/strong><\/li><li data-section-id=\"mlshzk\" data-start=\"5244\" data-end=\"5306\"><strong>or otherwise correctly addressed from a customs clearance perspective.<\/strong><\/li><\/ul><p dir=\"auto\" data-start=\"5308\" data-end=\"5336\">Those are customs questions.<\/p><h2 class=\"PDq2pG_selectionAnchorContainer\" dir=\"auto\" style=\"text-align: center;\" data-section-id=\"z8eur2\" data-start=\"5343\" data-end=\"5384\">The Word &#8220;CLEARED Is Not The Evidence<\/h2><p class=\"\" dir=\"auto\" data-start=\"5386\" data-end=\"5496\">For a high value yacht with its TAX exemption at stake, verbal reassurance should never be the only basis on which an owner or captain relies.<\/p><blockquote><p dir=\"auto\" data-start=\"5498\" data-end=\"5607\">The owner should be able to establish what customs position the yacht has and what documentation supports it.<\/p><\/blockquote><p dir=\"auto\" data-start=\"5609\" data-end=\"5694\">This does not necessarily mean carrying a large folder of paperwork around the yacht.<\/p><blockquote><p dir=\"auto\" data-start=\"5696\" data-end=\"5780\">It means knowing that there is a &#8220;trail&#8221;
